DHL Express (Poland) sp. z o.o delayed the delivery of an international shipment. In the court the defendant company argued that it was not obliged to deliver the consignment within a specified period, and that the compensation claims of its customers were – in relation to the content of the Regulation – limited. The court agreed with our client. In the course of the proceedings, among others, we raised that the parties individually agreed conditions of carriage and that international conventions prohibited the limitation of liability.
